When NRIs need a Non-Availability of Birth Certificate, the first decision is which type to obtain — an NABC issued by the Indian Embassy in their country of residence, or an NABC issued by the Indian Municipal authority at their place of birth. Both are legally valid but each suits different scenarios. This guide explains the difference and helps you choose.

What is an Embassy NABC?

An Embassy NABC is a Non-Availability of Birth Certificate issued by an Indian Embassy or Consulate abroad — for example, the Embassy of India in Washington DC, the High Commission of India in London, the Indian Consulate in Dubai, or the Consulate General in Sydney. It is issued on Embassy letterhead, signed by a consular officer, and bears the Embassy's official seal.

The Embassy NABC is issued based on the applicant's own affidavit declaring that no birth certificate is available, supported by secondary documents. The Embassy does not actually search Indian municipal registers — it issues the NABC on the basis of the sworn declaration and supporting evidence presented.

What is an Indian (Municipal) NABC?

An Indian Municipal NABC is issued by the local Registrar of Births and Deaths (Municipal Corporation, Nagar Nigam, or Gram Panchayat) at the actual place of birth, after a formal search of the birth register has been conducted for the relevant period. It states explicitly that the register has been searched and no entry was found.

This NABC carries more evidentiary weight because it confirms an actual records search — but it is harder to obtain because it requires liaison with the local authority at the place of birth.

Which authorities accept Embassy NABC and which require Municipal NABC?

The acceptance varies by destination authority:

  • USCIS (US Green Card): Embassy NABC is generally accepted, with supporting documents and affidavits. Some USCIS officers prefer the Municipal NABC for added authenticity.
  • IRCC (Canadian PR): Embassy NABC is widely accepted.
  • UK Home Office: Embassy NABC is accepted; some caseworkers request additional supporting documents.
  • Australian Department of Home Affairs: Embassy NABC accepted.
  • OCI / Indian passport: Both accepted; the Indian Mission abroad typically expects Embassy NABC since they are the issuer.
  • UAE, Saudi, Qatar embassies in Delhi (for attestation): Typically require Municipal NABC issued in India and apostilled by MEA.

When in doubt, the Municipal NABC + MEA apostille is the most robust and universally accepted combination.

How do I choose between Embassy NABC and Municipal NABC?

Use Embassy NABC when:

  • You are submitting to USCIS, IRCC, UK Home Office, Australian Home Affairs, or Indian missions (OCI, passport)
  • You have all supporting documents already (school records, passport, parents' affidavits)
  • Speed is important — Embassy NABC is typically faster (2-4 weeks) than coordinating with an Indian Municipal Corporation
  • You are in a country with a responsive Embassy

Use Municipal NABC when:

  • The receiving authority specifically demands a Municipal NABC
  • You are submitting to embassies in India (UAE, Saudi, Qatar, Kuwait) for non-Hague attestation
  • You want maximum evidentiary strength because your case is complex (e.g., adopted, late-registered later then unavailable)
  • You are doing a court case in India
Can I get both an Embassy NABC and a Municipal NABC?

Yes. Many NRIs obtain both because different authorities have different preferences. For example, you might need:

  • Embassy NABC for the US Green Card application
  • Municipal NABC + MEA apostille + UAE Embassy attestation if you also plan to use it for UAE residency in the future

Is the Embassy NABC apostilled or attested?

The Embassy NABC is issued by the Indian government (through its Mission abroad) and is generally accepted by the destination country authorities directly, without further apostille. However, if you plan to use it outside the country where it was issued (e.g., NABC issued by Embassy in Washington DC, then used in Germany), you may need to apostille it locally by the US State Department.

The Municipal NABC, on the other hand, must go through the full Indian apostille chain: SDM/Home Department attestation → MEA Apostille → Embassy attestation (for non-Hague countries).

Can the Embassy NABC be issued for any date of birth?

The Embassy will issue NABC for any date of birth, but you must provide credible secondary evidence of that date. The Embassy generally relies on:

  • School leaving certificate showing the date
  • Passport showing the date (your existing Indian passport)
  • Aadhaar showing the date
  • Affidavits from parents

If your various IDs show different dates of birth (a common issue for older NRIs), the Embassy will require you to first reconcile the discrepancy — typically through a date of birth correction process (see blog 27) — before issuing NABC.
