Birth Certificate for UK Settlement Visa and ILR – Home Office Requirements

Birth Certificate for UK Settlement Visa and ILR – Home Office Requirements

For NRIs applying for UK Settlement Visa, Indefinite Leave to Remain (ILR), or British citizenship, an apostilled Indian birth certificate is required. The UK Home Office has specific expectations for Indian documentation. This guide explains what to submit and how to handle common issues.

When is a birth certificate required for UK immigration?

The UK Home Office requires birth certificates for:

  • Family visas — spouse, partner, parent, child visas (to establish relationships)
  • Settlement applications (ILR) — supporting documents
  • British citizenship by registration / naturalisation
  • Children's UK passport applications for British-born children of Indian parents
  • Ancestry visa for Commonwealth citizens with UK-born grandparents
  • Family reunion — for refugees and humanitarian cases

What does the UK Home Office accept as a valid Indian birth certificate?

UK Home Office accepts: original Indian birth certificate issued by a Municipal Corporation, Cantonment Board or Panchayat; the certificate must be in English or accompanied by a certified English translation; the certificate must be apostilled by the MEA, Government of India under the Hague Convention (UK is a Hague country). For NRIs without a birth certificate, NABC from Indian Embassy in UK (or High Commission of India in London) is accepted with supporting documents.

How do I obtain an Indian birth certificate from London?

From the UK, you have several options:

  1. If born in India and birth was registered — apply for a fresh certificate or duplicate from the issuing Indian Municipal authority through a service like India For NRI. The original is apostilled and couriered to your UK address.
  2. If birth not registered — apply for NABC at the High Commission of India in London or the Birmingham/Edinburgh Consulates. Combine with school records and affidavits.
  3. If correction needed — file correction application in India through our service.
What is the High Commission of India NABC process in London?

The High Commission in London issues NABCs through VFS Global. Process:

  1. Book appointment at VFS Global's UK Indian consular services page
  2. Complete the Miscellaneous Services application form
  3. Submit notarised supporting documents — passport, school certificate, parents' affidavits, UK address proof
  4. Pay consular fee (~£20-50) plus VFS service fee
  5. Submit at VFS centre (London, Manchester, Edinburgh, Glasgow, Birmingham, Cardiff)
  6. Collect or receive by post in 2-4 weeks

UK Home Office accepts London HCI NABCs routinely.

Does the UK Home Office require the apostille to be recent?

UK Home Office does not specify a formal recency rule, but caseworkers typically expect apostille within the past 12 months for settlement and family visa applications. For citizenship applications (after years of residence in the UK), older apostilles are often accepted. We recommend re-apostille if over 18 months old before fresh visa submissions.

What if my birth certificate has discrepancies with my passport?

Name or date of birth discrepancies between your birth certificate and passport cause UKVI caseworkers to issue queries. Resolve before submission:

  • Identify which is correct (usually passport)
  • Get birth certificate corrected in India
  • Apostille the corrected certificate
  • Submit with cover letter explaining the correction

Caseworkers are generally accommodating of properly explained corrections.

What about birth certificates for children born in the UK to Indian parents?

Children born in the UK have UK birth certificates issued by the General Register Office (or Northern Ireland / Scotland equivalent). For UK immigration purposes, the UK birth certificate is the primary document. However, if the child needs:

  • An Indian passport — register the birth with the Indian High Commission/Consulate in UK
  • OCI card — birth certificate of the parent (showing Indian origin) is needed

We assist with consular registration of births of NRI children abroad.
