DELHI NRI PROPERTY OVERVIEW

Delhi (NCT) and broader NCR (Gurugram, Noida, Ghaziabad, Faridabad) host one of the largest NRI property bases in India — driven by historical Delhi diaspora and concentration of high-value commercial real estate.
Delhi has unique legacy issues: GPA-based "sales" that the Supreme Court invalidated, DDA leasehold properties requiring freehold conversion, and unauthorised colonies under various regularisation schemes.

KEY DELHI SPECIFICS

Local Authority: MCD (Municipal Corporation of Delhi) — unified after 2022 (previously North/South/East MCD); NDMC for New Delhi area; DDA (Delhi Development Authority) for DDA flats. GPA SALE LEGACY — A DELHI-SPECIFIC TRAP

Delhi NCR has the largest legacy of "GPA sale" properties in India: - Many DDA flats and unauthorised colony properties changed hands historically through GPA + Will + Agreement to Sell + Possession Letter combinations rather than registered Sale Deeds. - Supreme Court in Suraj Lamp & Industries (2011) held GPA does NOT transfer ownership. - Many such properties remain in legal limbo — original owner of record is different from possessing person. - NRI buyers must verify chain of title carefully; insist on registered Sale Deed throughout the chain.

DDA LEASEHOLD AND FREEHOLD CONVERSION

DDA originally allotted flats and plots on lease (typically 99 years). Holders can apply for freehold conversion: - Apply through DDA online portal. - Pay conversion charges (varies by category and location, typically Rs 50,000-5,00,000). - Receive Conveyance Deed in your name. - Once freehold, full ownership rights including unrestricted sale, mortgage.

For NRI inheriting DDA flat from parent — apply for mutation in NRI's name, then freehold conversion if not already done; future sale much easier with freehold.

UNAUTHORISED COLONIES AND PM-UDAY

Delhi has approximately 1,800+ unauthorised colonies; significant residential population. Government schemes (PM-UDAY 2019, Delhi Special Provisions Acts) allow regularisation: - Resident applies for conveyance deed against fee. - Property becomes recognised; mutation, building permits, loans become possible. - For NRI inheriting unauthorised colony property — explore regularisation before sale.

DELHI STAMP DUTY GENDER CONCESSION

Delhi offers significant concession for women buyers — 4% vs 6% for men. For NRI joint purchase, at least one female owner enables the lower rate. Use cases: - NRI husband + Indian resident wife — wife as joint owner saves 2% stamp duty. - NRI woman as primary buyer — entire purchase at 4%. - Two-female joint ownership (mother-daughter, siblings) — full concession.

DELHI MCD MUTATION

After Sale Deed registration: - Apply for MCD mutation through MCD online portal (mcdonline.nic.in). - Submit Sale Deed, identity proof, property tax challans. - Pay mutation fee (Rs 1,000-5,000). - Field officer may visit; may take 30-90 days.

Property tax in Delhi follows unit area method — calculated on built-up area, factor based on locality category, age, occupancy.

DELHI NRI MISTAKES

(1) Buying GPA-based properties without freehold conversion — defective title; future resale problematic.

(2) Buying in unauthorised colonies without regularisation — title remains questionable.

(3) Not utilising women buyer stamp duty concession — losing 2% on entire transaction.

(4) MCD property tax arrears — property bought from sellers with old unpaid taxes; clean before purchase.

(5) DDA property nominee not updated — old nominee from previous owner causes complications on inheritance.
