US Tax Refund for NRIs — How to Get It in India

When do you get a refund?

If your withholding (W-2, 1099, FIRPTA) + estimated payments exceed your actual tax liability, you're entitled to refund.

Common NRI refund situations:

  • Over-withholding on US salary (very common for visa holders)
  • FIRPTA withholding > actual capital gains tax
  • 1099 withholding > tax owed
  • Refund of excess withholding on US rental property

How is refund issued?

Two options on Form 1040:

  1. Direct deposit to US bank account
  2. Paper check mailed to address on return

NRIs in India usually receive paper check at Indian address. Direct deposit requires US bank routing number — only useful if you have US bank account.

Processing time

  • E-filed return + direct deposit: 21 days typical
  • E-filed + paper check: 30-45 days
  • Paper-filed return: 6-8 weeks
  • Paper return with foreign address: 10-12 weeks
  • Amended return refund (1040-X): 16+ weeks
  • ITIN application refund: 11+ weeks

NRI returns to foreign address are slower. Plan accordingly.

Receiving check in India

IRS sends paper check to address on return. For Indian address:

  • USPS international mail
  • 4-6 weeks transit
  • Track via IRS "Where's My Refund?" tool

Once received: deposit in US bank if you have one. Otherwise, US-currency check needs special handling:

  • Some Indian banks accept USD checks for collection (60-90 days, fee)
  • US-correspondent bank route — Indian bank sends check to US correspondent
  • Slow but works

Better: Open a US bank account before filing, get direct deposit.

Direct deposit to Indian bank?

IRS does NOT direct deposit to foreign banks. Direct deposit requires US routing number and US bank account.

Some workarounds:

  • US-domiciled FBO account at Indian bank (some banks offer)
  • Online banks accepting NRI customers (Wise, similar)
What if refund is delayed?

Use "Where's My Refund?" tool on irs.gov. Status shows:

  • Received
  • Approved
  • Sent

If status shows "Approved" but you haven't received:

  • Wait 6 weeks if mailed to foreign address
  • After 6 weeks, file Form 3911 (Taxpayer Statement Regarding Refund)
  • IRS researches and reissues if check lost

If status hasn't moved for 60+ days:

  • Call IRS NRI office: 267-941-1000 (international)
  • Or write to IRS Austin
ITIN-pending refunds

If you filed return with Form W-7 for spouse ITIN:

  • Refund won't issue until ITIN approved
  • Add 11+ weeks to standard processing
  • ITIN issued first, then refund processed
Splitting refund

Form 8888 lets you split refund across up to 3 accounts. Useful for:

  • Direct deposit portion to US bank + paper check portion to Indian address
  • Multi-account allocation for couples
Interest on delayed refunds

IRS pays interest on refunds delayed more than 45 days past return due date or filing date (whichever later). Rate currently ~7-8% annual.

Interest is taxable income in the year received.

Amended return refunds (1040-X)

If amending past return to claim refund:

  • Statute of limitations: 3 years from original return filing date
  • Past that, refund forfeited
  • Processing: 16-20+ weeks
  • Paper-only for most amendments

For NRIs claiming refunds via Streamlined Procedure: each year's refund processed separately, 6+ months typical.

Common refund mistakes
  • Wrong address on return (check goes to old US address)
  • Bank account closed (direct deposit fails)
  • Math errors (refund adjusted)
  • Missing forms (refund delayed pending docs)
  • Filing past statute (refund forfeited)

  1. E-file when possible — fastest
  2. Keep US bank account open for direct deposit
  3. Use current address on return
  4. Track via IRS tool weekly
  5. File Form 3911 if check delayed 6+ weeks
  6. Maintain US bank for 1-2 years post-move for refund receipt
