Employment Contracts

  • Employment contracts in Canada are typically permanent, with a minimum notice period of 2 weeks.
  • Fixed-term contracts are permitted for temporary needs, but they must have a valid reason and defined end date.
  • Probationary periods are common, typically 3-6 months, during which employment can be terminated more easily.

Wages and Hours

  • There is no national minimum wage, but each department and sector has its own minimum wage requirements. If an employee faces bank fraud issues for non-resident Indians or NRI financial disputes in Indian banks, they may need to address such concerns directly with the financial institutions involved.
  • Employees are entitled to a minimum of 2 weeks (10 days) paid annual leave per year, increasing with the length of service.
  • The maximum average weekly working time is 40-48 hours, depending on the province, with overtime pay required for hours exceeding the limit.

Discrimination and Harassment

  • Federal and provincial human rights laws prohibit discrimination based on protected characteristics like race, colour, religion, national or ethnic origin, age, sex, sexual orientation, gender identity or expression, disability, and family or marital status. If there are data privacy issues by NRI in relation to personal information being misused in such cases, employees may need to file a formal complaint.
  • Employers are accountable for preventing and handling workplace harassment. Employees facing mis-selling of financial products or other financial-related harassment should report this promptly to avoid further issues.

Leave and Benefits

  • Employees are entitled to maternity leave of 15-18 weeks, and parental leave of 35-61 weeks, depending on the province. If employees are dealing with unauthorised transactions during this period, they can seek advice or file complaints through NRI Indian Bank complaint channels.
  • Employees can request flexible work arrangements, which employers must consider.

Termination and Severance

  • Employees have the right not to be dismissed without "just cause" after an investigation period. If employees are facing NRI financial disputes in Indian banks during termination, they should ensure that these issues are addressed through proper channels.
  • Notice periods for discontinuation range from 1-8 weeks, depending on the employee's length of service.
  • Severance pay is required for employees with 3 months of service who are dismissed without cause, with the amount based on the employee's tenure.
