Step-by-Step Guide to Property Registration in India

Step 1:
Start by estimating the value of your property based on the circle rate in your region. This is a crucial step for NRI selling inherited property in India or NRI inheriting property in India, as the valuation impacts tax and legal considerations.

Step 2:
Compare the circle rate with the actual purchase price. The stamp duty for property registration must be paid on the higher of the two amounts. Ensure these calculations are accurate to avoid issues during the registration of the agreement to sell.

Step 3:
Purchase non-judicial stamp papers equal to the determined value. These papers will be used for drafting the sale deed, which outlines the transfer of ownership details.

Step 4:
Obtain stamp sheets, which can be physical or electronic (e-stamps). If the stamp duty has been paid, provide proof of payment. For NRI selling property in India, ensure compliance with any additional documentation required by the Collector of Stamps.

Step 5:
Prepare the deed on the stamp papers. The content varies based on the transaction type—purchase, lease, mortgage, power of attorney, etc. When drafting a sale deed, ensure all critical clauses are included to protect both parties' interests.

Step 6:
All parties involved in the transaction must visit the Sub-Registrar’s office with two witnesses to record the deed. Bring the following:

  • Original and two photocopies of the deed of sale.
  • Photos and identity documents of all parties.
    This step is vital for ensuring the review of agreement to sell and the sale deed complies with legal requirements.

Step 7:
After successful recording, you will receive a receipt of property registration. Within 2–7 days, revisit the Sub-Registrar’s office to collect the registered sale deed.

Step 8:
Verify the registered sale deed using property registration details. If discrepancies are found, seek legal advice promptly. This is particularly important for NRI selling inherited property in India, as errors can lead to prolonged disputes.

Mutation Process:
After property registration, apply for a mutation to transfer ownership officially with the Land Revenue Department. This step enables the government to update property records and collect property taxes from the rightful owner.
