Safeguards Against Unauthorized Property Sales

  1. File a Caveat:
    File a caveat with the concerned Sub-Registrar's office to prevent the registration of agreement to sell or any deed of sale without your knowledge. This ensures you are notified before any unauthorized transaction takes place.

  2. Obtain a Prohibitory Injunction:
    Approach the court to obtain a prohibitory injunction, restraining the other party from drafting a sale deed or transferring the disputed property without your consent.

  3. Register the Dispute:
    Officially register the dispute over the property with the Sub-Registrar or Revenue Department. This is particularly important in cases of NRI selling inherited property in India or disputes related to NRI inheriting property in India.

  4. Publish a Public Notice:
    Publish a public notice in a local newspaper, informing the public about the dispute over the property and warning potential buyers. This can deter any unauthorized deed of sale or transaction.

  5. Maintain Detailed Records:
    Carefully document all communications, legal notices, and court proceedings related to the property dispute. Such evidence can be vital for a review of the agreement to sell or if the property is sold without your knowledge, particularly in cases involving NRIs selling property in India.
