Legal Heir Property Transfers: Registering a Valid Relinquishment Deed

As per Section 17 of the Registration Act, 1908, a Relinquishment Deed must be registered to be legally valid. This document allows a legal heir to transfer their share of inherited property to other heirs.

Steps to Register a Relinquishment Deed:

  1. Drafting the Deed: Start with NRI Relinquishment Deed Drafting or consult a lawyer for a precise format. Platforms like India for NRI offer assistance for Drafting Relinquishment Deed Format.
  2. Stamp Paper: Print the deed on ₹100 stamp paper and include all property details.
  3. Submission: File the deed with the sub-registrar in the property’s jurisdiction.
  4. Pay Fees: Pay the relinquishment deed stamp duty, which varies by state.
  5. Registrar Visit: Both parties and two witnesses must visit the sub-registrar with the required documents.
  6. Completion: After verification, the Relinquishment Deed Registration is completed, and a registered copy is issued within a week.

For physically challenged individuals, Section 31 permits the registrar to visit the presenter for deed registration. Remember, an unregistered relinquishment deed holds no legal validity and cannot be contested in court.
