SC Rulings on Mutation: No Confirmation of Property Title

The Supreme Court (SC) has reiterated that revenue records do not confirm ownership. Mutation neither establishes nor extinguishes title; it only authorizes the individual to pay land revenue.

  • No Title Validity: In Sawarni vs. Inder Kaur, the SC clarified that mutation holds no presumptive value of ownership.
  • Landmark Cases: In P Kishore Kumar vs. Vittal K Patkar and Balwant Singh vs. Daulat Singh, the SC ruled that mutation records cannot override legal ownership.
  • Accuracy: Records of rights are not always accurate and must be supported by legal evidence (Sita Ram Bhau Patil vs. Ramchandra Nago Patil).

  • Mutation after death is crucial for updating ownership records for heirs.
  • The time limit for the Mutation of Land varies by state; delays can cause complications.
