For Indian citizens married in India and now residing abroad, the jurisdiction for divorce depends on several factors:

 

1. Mutual Divorce-

Jurisdiction: You can file for a mutual divorce in any Indian state where you meet the residency requirements. The process must comply with Indian laws and be validated by an Indian court, even if you are living abroad. If you are an NRI, you may need to first complete NRI marriage registration in India or have an official marriage certificate for NRI in India for your divorce petition to be processed.

Process: Ensure that the mutual divorce is processed and recognized by an Indian court to have legal validity in India. If needed, ensure that the marriage registration process has been completed before filing for a mutual divorce.

2. Contested Divorce-

Jurisdiction: Only Indian courts have jurisdiction to grant a contested divorce for marriages solemnized in India. If one spouse seeks a divorce decree in a foreign court, it can be contested by the other spouse under Indian law. Marriage registration in India for NRI plays a crucial role in the recognition of marriage in Indian courts.

Recognition: Indian law does not automatically recognize foreign divorce decrees. The decree must be validated by an Indian court to be legally effective in India. If the marriage was registered under NRI Marriage Registration, an Indian marriage certificate will be required for the divorce validation.

3. Validity of Foreign Decrees-

Recognition: Even if a foreign court issues a divorce decree, it may not be recognized by Indian authorities. For legal purposes such as name changes or other formalities, an Indian court decree is required. If you need a legal marriage certificate for validation, it’s important to know how to obtain a marriage certificate in India.

In summary, whether seeking a mutual or contested divorce, Indian citizens living abroad must navigate the legal processes of Indian courts to ensure their divorce is recognized in India.
